Terms and Conditions

These Terms and Conditions (“Terms”) govern all equipment hire agreements (“Hire”) between Trinium Plant Hire Pty Ltd (“Trinium”, “we”, “us”, or “our”) and the Hirer (“you” or “the Customer”).
By booking or hiring any equipment from Trinium Plant Hire, you acknowledge that you have read, understood, and agree to be bound by these Terms.


1. General Conditions of Hire

1.1 Eligibility:
Equipment is hired only to persons aged 18 years or older who hold the appropriate qualifications, licences, and experience required to safely operate the equipment.

1.2 Ownership:
All hired equipment remains the property of Trinium Plant Hire Pty Ltd at all times. No ownership or title passes to the Hirer under any circumstances.

1.3 Hire Period:
The hire period commences upon delivery or collection and continues until the equipment is formally off-hired by the Customer and confirmed by Trinium. Daily, weekly, or monthly hire charges will apply according to the rate schedule at the time of booking.

1.4 Hire Confirmation:
By placing an order online, by phone, or in person, you agree to these Terms, the quoted hire rate, and all associated fees.


2. Payments and Security

2.1 Payment Method:
Payment may be made via approved credit/debit card, EFT, or other agreed method. By hiring through Trinium, you authorise us and our payment processor (e.g. Stripe) to securely store your payment information and charge your card for all hire and related costs as outlined below.

2.2 Security Authorisation:
Your card may be pre-authorised for a security bond or damage deposit prior to the commencement of hire.

2.3 Automatic Charges:
Unless the equipment has been off-hired before 5:00 PM, your card may be charged for additional hire days.

2.4 Late Payments:
Overdue accounts may incur interest and recovery fees. Trinium reserves the right to charge all collection costs, legal fees, and administrative expenses for unpaid amounts.


3. Off-Hire and Return of Equipment

3.1 Off-Hire Notification:
To off-hire, you must contact Trinium by phone or submit an off-hire form online before 5:00 PM. Hire fees continue until the equipment is off-hired and collected.

3.2 Condition Upon Return:
All equipment must be returned clean, undamaged, and in good working order.

3.3 Additional Charges:
Trinium reserves the right to charge your card for:

  • Cleaning: $85/hour (excl. GST) for excessively dirty equipment.
  • Damage Repair: Actual cost of repairs or parts.
  • Fuel Replacement: $3.50/L (excl. GST) for diesel machines not returned with a full tank.
  • Call-Out Fees: Minimum $100 for non-scheduled site visits caused by misuse or customer error.
  • Missing Items: Full replacement cost of any accessories (e.g., safety harnesses).

3.4 Failure to Return Equipment:
If equipment is not returned after off-hire, Trinium may enter the premises to recover the equipment or charge the replacement value to the Customer’s card.


4. Use of Equipment

4.1 Safe Use:
You must:

  • Operate equipment only for its intended purpose and in accordance with Australian safety standards and manufacturer instructions.
  • Use appropriate PPE (Personal Protective Equipment).
  • Comply with all workplace health and safety laws.

4.2 Prohibited Use:
You must not:

  • Use the equipment on unsuitable surfaces (e.g., grass for non-4WD scissor lifts).
  • Modify, tamper, or repair equipment without approval.
  • Allow unauthorised persons to operate the machinery.
  • Move equipment from the delivery site without Trinium’s written consent.

4.3 Operator Requirements:
Operators of elevated work platforms (e.g., boom lifts) must maintain 4 metres clearance from powerlines and wear safety harnesses at all times.

4.4 Breakdowns:
If equipment becomes inoperative, contact Trinium immediately. Our liability is limited to repair, replacement, or refund of the hire fee for the affected period.

4.5 Risk and Responsibility:
Use of the equipment is entirely at your own risk. Trinium is not liable for injury, loss, or damage resulting from misuse, negligence, or failure to follow instructions.


5. Insurance, Damage, and Theft

5.1 Insurance Responsibility:
Unless otherwise stated, the Hirer is responsible for all loss, theft, or damage to hired equipment during the hire period.

5.2 Damage or Loss:
If equipment is damaged, stolen, or lost, you are liable for:

  • Full replacement value if unreturned.
  • Repair costs (if applicable).
  • Recovery expenses (e.g., crane hire for bogged equipment).

5.3 Exclusions:
Damage Waiver or insurance (if offered) does not cover:

  • Misuse, overload, negligence, intoxication, or unlicensed operation.
  • Damage due to transport or operation on unsealed or unsafe sites.
  • Flooding, fire, or other external causes.

6. Data and Privacy

6.1 Equipment Tracking:
Certain equipment may include GPS devices for tracking, safety, and maintenance purposes. By hiring, you consent to Trinium collecting and using such data.

6.2 Customer Data:
Personal information is collected and used in accordance with our Privacy Policy and the Australian Privacy Principles (APPs).

6.3 Cookies:
When using our website, temporary cookies may be stored to improve user experience and remember login preferences.


7. Liability and Indemnity

7.1 Limitation of Liability:
To the maximum extent permitted by law, Trinium excludes all liability for:

  • Indirect or consequential loss.
  • Damage to property or third parties arising from use or misuse of equipment.

7.2 Australian Consumer Law:
Nothing in these Terms limits your rights under the Australian Consumer Law (ACL). Where applicable, our liability is limited to repair, replacement, or refund of the hire fee.

7.3 Indemnity:
You agree to indemnify Trinium Plant Hire for all costs, claims, damages, and expenses resulting from your breach of these Terms or negligent use of equipment.


8. Termination and Default

8.1 Trinium may terminate the hire and recover equipment immediately if you:

  • Fail to make payment when due.
  • Misuse, damage, or attempt to sell equipment.
  • Become insolvent or cease business.

8.2 Upon termination, Trinium may enter any premises to repossess its equipment without notice.


9. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be submitted to the jurisdiction of the courts of NSW.
